Just a question, did this box have a postage label that the seller printed out or did the PO apply the postage label?

If I remember correctly, it was a post office label. I can't find the damned box anywhere, but I don't want to just give up on this, trying to turn up the heat under this guy till he pays back. |

Well if the PO applied the postage label, it should have the weight displayed. That will tell you right there whether it is the PO or the seller.
Hopefully the guy sent a package that weighs under what it should have been, fraud will be very easy to prove then. |

the police investigate crimes. if the guy shipped the stuff and the post office screwed up, you can sue him for the tort of fraud. it would only be criminal if he never shipped the stuff in the first place. the weight displayed on the shipping label would be very good evidence of what really happened, althouth of course it might have been rocks that he shipped and there would be no way to tell. |

Sorry you lost out here.
However, when dealing with the PO or EBAY, you've got to know their guidelines when you do business with them. I guess the bottom line is that if you suspect loss, it is incumbent upon you to be pro-active and deal with the problem quickly when using their beaurocracy. |

| Definitely an unfortunate situation. You can't blame the USPS for limiting the claim to $15 though if he only purchased regular insurance. Bullion can only be fully insured through Registered Mail...there are numerous threads on this subject here and on all of the other major metal forums. The 45 day limit to file an eBay/PayPal dispute has been around for awhile. In fact I think it used to only be 30 days. The eBay "Resolution Center" is separate from feedback, and they changed the look of it recently. I currently have a case pending for items lost due to inadequate packaging... |

I have been here myself on a E-bay purchase of $300.00. Seller was way down in SC and thought he was safe. No sir! I contacted the DA in his city and told him the story, he was quite interested and was willing to file charges. That scared the seller into sending a check back to me. Here is where it gets real funny. There is another scott in my hometown, with a last name that is just two letters different than mine. So this jerk sends me a PO money order, addressed to me on the envalope, then on the MO itself, he fills it out in this other Scott's name and address, thinking I would not catch it. Well turns out this other Scott dude is my son's 4-H leader, so we went together to the post office and cashed it. About a week later the seller e-mailed me and said I was going to jail for forgery! I sent him a e-mail back, thanking him for the refund, and the the other Scott was a good friend. Never heard from him again!
As for the case of the missing coins, talk to your local county attourney and see if you can file in small claim court against the seller. He would have to come to you to defend himself, if he don't show up the judge will find in your favor. Then the real fun can begin!

| I had to call eBay to finish up my case. They issued a coupon code for the amount I was seeking, valid for 1 year. Not quite as nice as a refund would have been, but works for me... |

First I must preface my comments by saying I have an all positive feedback of over 2000 with no negatives and been a member since Jan 1997 on eBay!
Regardless,I have lost a lot more than that on eBay. However, when I use PayPal I charge the transaction to my AMEX and never draft it out of a bank account regardless of if they say I am covered or not.
Trust me, I know full well eBay is not out for my best interest!
If I have a problem I call AMEX and let them deal with eBay and I don't worry about it. AMEX even credits my account while they are looking into it.
The term "buyer beware" applies just as much to the seller as the one helping broker the deal i.e. eBay! |
